Hannah Arendt's rich and varied political thought is more influential today than ever before, due in part to the collapse of communism and the need for ideas that move beyond the old ideologies of the Cold War. As Dana Villa shows, however, Arendt's thought is often poorly understood, both because of its complexity and because her fame has made it easy for critics to write about what she is reputed to have said rather than what she actually wrote. (...) class='Hi'>Villa sets out to change that here, explaining clearly, carefully, and forcefully Arendt's major contributions to our understanding of politics, modernity, and the nature of political evil in our century.Villa begins by focusing on some of the most controversial aspects of Arendt's political thought. He shows that Arendt's famous idea of the banality of evil--inspired by the trial of Adolf Eichmann--does not, as some have maintained, lessen the guilt of war criminals by suggesting that they are mere cogs in a bureaucratic machine. He examines what she meant when she wrote that terror was the essence of totalitarianism, explaining that she believed Nazi and Soviet terror served above all to reinforce the totalitarian idea that humans are expendable units, subordinate to the all-determining laws of Nature or History. Villa clarifies the personal and philosophical relationship between Arendt and Heidegger, showing how her work drew on his thought while providing a firm repudiation of Heidegger's political idiocy under the Nazis. Less controversially, but as importantly, Villa also engages with Arendt's ideas about the relationship between political thought and political action. He explores her views about the roles of theatricality, philosophical reflection, and public-spiritedness in political life. And he explores what relationship, if any, Arendt saw between totalitarianism and the "great tradition" of Western political thought. Throughout, Villa shows how Arendt's ideas illuminate contemporary debates about the nature of modernity and democracy and how they deepen our understanding of philosophers ranging from Socrates and Plato to Habermas and Leo Strauss.Direct, lucid, and powerfully argued, this is a much-needed analysis of the central ideas of one of the most influential political theorists of the twentieth century. In this paper, I argue that Gloria Anzaldúa’s own philosophical concept of la facultad captures a form of active, embodied, epistemic agency. I further argue that when an agent uses la facultad, they acquire a novel form of knowledge, one that is only accessible through this capacity. In Section II, I define la facultad as consisting in the active integration of conscious self-awareness, bodily experiences, motor skills, and sensory information with the rational mind to engage with and navigate the world. As such, the actions we choose to are not solely determined by reasoning or mere mental states but are fundamentally shaped by the dynamic interplay between our bodies, sensory perceptions, emotions, and the situational context in which we find ourselves. This paper aims to address the difficulties of high school students in bridging their computational understanding with their visualization skills in understanding the notion of the limits in their calculus class. This research used a pre-experimental one-group pretest-posttest design research on 62 grade 10 students enrolled in the Science, Technology, and Engineering Program (STEP) in one of the public high schools in Zamboanga del Sur, Philippines. A series of remedial sessions were given to help them understand the function values, one-sided (...) limits, limits of a function, and its discontinuities with the aid of the GeoGebra. Results revealed that there is a significant improvement in their mathematics performance before and after the remediation, t(61) = -19.99, p<.05. The real-time feedback provided by the drawing interface of GeoGebra has provided the students the insights into how objects behave in geometrical space, bridging their understanding in locating the values shown by the computational algebraic processes. Additionally, the significant difference in the achievement reveals a large effect size (Cohen’s =2.54) which could be accounted for by the remediation using interactive activities in the GeoGebra. This paper explores the ancient philosophical school of Cynicism, its key principles, and its most famous proponent, Diogenes of Sinope. It asserts that George Carlin, a modern comedian, embodies the spirit of Cynicism through his sharp social commentary, fearless critique of societal norms, and advocacy for self-sufficiency and freedom. Drawing parallels between Diogenes and Carlin, the paper highlights three core Cynic values: self-sufficiency, living according to nature, and parrhesia (fearless speech). Diogenes, known for his ascetic lifestyle and provocative public actions, (...) championed the rejection of societal conventions and materialism, advocating for a life in harmony with nature. Similarly, Carlin's comedy, marked by irreverence and critique of societal hypocrisies, challenges cultural norms and exposes contradictions in political and ideological systems. Through his routine, Carlin exemplifies parrhesia by boldly confronting taboos and speaking truth to power, much like Diogenes did through his radical actions. The paper argues that Carlin’s satirical humor and philosophical reflections align with the Cynic tradition, using comedy as a tool for philosophical inquiry and societal critique. By comparing Carlin to Diogenes, the paper posits that Carlin’s comedic legacy should be recognized as a modern continuation of the ancient Cynic ethos, making him a contemporary counterpart to the father of Cynicism. The study underscores the relevance of Cynic philosophy in modern society, emphasizing its role in challenging conformity and promoting critical reflection on societal values. (shrink)

This study examines the relationship between sustainability and employee perceptions of Human Capital Management (HCM) practices in Cebu City's Business Process Outsourcing (BPO) industry. The participation of 370 different BPO companies at Cebu I.T. Park indicates their dedication to HCM and highlights areas that require improvement, particularly in labor relations and HRIS deployment. Employee evaluations are influenced by demographic factors such as age, gender, and educational attainment. Suggestions for improvement include implementing employee development plans, streamlining the HRIS, strengthening due process, (...) integrating sustainability into HCM practices, and personalizing strategies based on demographics. To foster adaptable workplaces and keep pace with the changing BPO landscape, it is strongly advised to employ continuous monitoring and feedback mechanisms. (shrink)

This study looks at the relationship between organizational support, employee commitment, and human resource management (HRM) practices at Visayan Surety & Insurance Corporation in Cebu City, Philippines. This descriptive-correlational study used a survey questionnaire to gather data from 25 employees. The results show that although the company does a great job in areas like leadership development and talent management, employee development initiatives could need some work. The study also emphasizes the importance of organizational support in promoting employee commitment and the (...) necessity of continual efforts to establish a supportive work environment. Additionally, demographic profiles have little bearing on HRM procedures and organizational support—except educational attainment, which affects several organizational commitment factors. These results highlight how crucial it is to develop tailored HRM strategies that both fit the varied demands of the workforce and the objectives of the company. (shrink)

This research examines how it is to have tailored training programs to improve behavior at work. It focuses on aspects including interpersonal skills, communication, adaptability, and work ethics. Acknowledging the paucity of empirical research on particular training requirements for these characteristics, the study uses a descriptive-correlational methodology to examine information from ninety production employees at Fine Interiors Trading and Manufacturing Incorporated. To guarantee participation from a range of employment roles, participants were chosen using purposive sampling. Utilizing an extensive survey to (...) evaluate training requirements and demographic data. An assessment of the relationship between training requirements and demographic factors was done using statistical methods such as Chi Square tests and descriptive statistics. The findings indicate that different people have different levels of training demands, and there are strong relationships between the training needs and age, civil status, length of service, educational attainment, assignment area, and employment status. The results highlight the need to tailor training initiatives to particular worker requirements, fostering ongoing enhancement and career advancement. This research adds to the body of knowledge in academia and has real-world implications for businesses looking to get the most out of their training initiatives. (shrink)

We may succed in the fulfilment of our desires but still fail to properly own our practical life, perhaps because we acted as addicts, driven by desires that are alien to our will, or as “wantons,” satisfying the desires that we simply happen to have (Frankfurt, 1988 ). May we equally fail to own the outcomes of our epistemic life? If so, how may we attain epistemic ownership over it? This paper explores the structural parallellism between practical and epistemic rationality, (...) building on Williamson’s ( 2002 ) suggestion that we should commence with successful performances as the foundation for both domains, be it action or knowledge. By highlighting the limitations of higher-order regulative approaches in epistemology, exemplified by Sosa ( 2007, 2011, 2015, 2021 ), the paper introduces a form of teleological epistemic constitutivism inspired by Velleman ( 2000, 2009 ). The proposal is that epistemic ownership is not attained in the mere pursuit of truth or knowledge, but requires furthermore a struggle to understand what we know. (shrink)

En cambio, al hacer referencia al terror romántico, se alega a una de las múltiples manifestaciones que adopta este paradigma en la actualidad. Para este estudio, delimito su precisión léxica (convencional), que es (...) identificable por abordar los mecanismos que producen la destrucción de la noción del amor, la aniquilación del personaje que se respalda en este dogma y la intervención macabra del manipulador en las obras artísticas de esta índole. Estas peculiaridades se adecúan principalmente al funcionamiento de un psicodinamismo de confrontación del bien con el mal, que es notoria en las estrategias de manipulación que son empleadas en las relaciones de pareja de Cuentos malévolos (1904), al igual que la exposición a situaciones de riesgo y la ausencia de criterios ético y religioso. According to the standard view, Montaigne’s Pyrrhonian doubts would be in the origin of Descartes’ radical Sceptical challenges and his cogito argument. Although this paper does not deny this influence, its aim is to reconsider it from a different perspective, by acknowledging that it was not Montaigne’s Scepticism, but his Stoicism, which played the decisive role in the birth of the modern internalist conception of subjectivity. Cartesian need for certitude is to be better understood as an effect of the Stoic (...) model of wisdom, which urges the sage to build an inner space for self-sufficiency and absolute freedom. The aim of this paper is to discuss a basic assumption tacitly shared by many philosophers of mind and language: that whatever can be meant, can be said. It specifically targets John Searle's account of this idea, focusing on his Principle of Expressibility . In the first part of the paper, PE is exposed underlining its analyticity and its relevance for the philosophy of language , mind , society and action . In the critical part, the notion of Background is (...) taken into account in order to re-evaluate two basic distinctions: the one between sentence and utterance meanings , and the one between native and type speakers . PE is reconsidered in the light of the previous arguments as a methodological strategy that does not prevent uses of language from eventual semantic excesses and deficits , and a complementary Principle of Expression Fallibility is finally proposed. The syllogism and the predicate calculus cannot account for an ontological argument in Descartes' Fifth Meditation and related texts. Descartes' notion of god relies on the analytic-synthetic distinction, which Descartes had identified before Leibniz and Kant did. I describe how the syllogism and the predicate calculus cannot explain Descartes' ontological argument; then I apply the analytic-synthetic distinction to Descartes’ idea of god.

Las violaciones de los Derechos Humanos se contienen eficientemente a través de la resistencia pacífica que conduce a resultados positivos. Codificar, señalar o clasificar lo que está mal no es suficiente. La idea se implementa con la protección del medio ambiente, la propiedad de la tierra, la consolidación de la comunidad y el empoderamiento de las mujeres cuando se desarrollan siguiendo los principios del Turismo de Base Comunitaria (TBC). A través de la investigación longitudinal, se realizó un estudio de caso (...) en la zona rural de Bogotá. Tres iniciativas de TBC fueron revisadas. Primero se realiza la contextualización, luego se analizan los principios del turismo comunitario y el concepto de resiliencia. Esto se generaría porque las letras de sus canciones estaban caracterizadas por un mensaje social y político que se vivía en ese entonces. Por ese motivo, el objetivo de este trabajo es que el artista revele qué hizo asequible que la transmisión de su ideal fuera bien recibida por la sociedad, sin (...) que tenga que enfrentarse a la censura o al silencio político. Más allá de ese contenido, debe destacarse que la melodía de sus canciones también hizo posible que la recepción fuera grata. Para finalizar, en esta conversación, se conocerá toda esa trayectoria musical que permitió que la banda RIO lograse un valor en la sociedad peruana que hasta hoy en día se le recuerda y se le escucha. The aim is to examine the multiple meanings of creativity in creative economy. The meanings which reinforce the individual aspect stress that personal characteristics may unlock the wealth that lies within people. The definitions that reinforce the organizational and social aspects understand creativity as a process, which requires knowledge, networks, and technologies that interconnect novel ideas and contexts. The perspectives which reinforce the political aspect see that creativity took the status of a doctrine to secure collaboration between government and industry. (...) Three arguments summarize opposition to laws protecting LGBTQ+ persons from discrimination: (1) The pseudo-democratic argument (social change should be free of governmental coercion); (2) The clinical argument (homosexuality is an illness); (3) The choice argument (homosexuality is a choice). My purpose is to show the three are vulnerable to damaging objections. This article reflects conditions as they were in 1987 in the USA. For example, the expression LGBTQ+ had not been coined. Standard interpretations of Descartes' work, especially those inspired by analytic philosophy, assume the syllogism and Principia Mathematica's artificial language are appropriate tools for interpreting Cartesianism, particularly the ontological argument. The dissertation shows technical problems arise when those logics are used for that purpose. An intentianal interpretation along Meinongian lines is proposed, as an alternative to deductive exegeses. This interpretation is developed after arguing that Russell did not identify what I call "the epistemic use" of Meinong's theory of objects. The proposed (...) interpretation is nonlogical in the sense that intentionality alone, not deductive arguments, explains the cogito and res cogitans' belief in god's existence. God is the only one of res cogitan's intentionalia in which existence is analytically included; thus, there is no need for an ontological argument. Such an interpretation is consistent with Descartes' rejection of syllogistics as a truth-discovering tool and provides a framework to evaluate Cartesianism and Kant's criticism of it. Moreover, some problems afflicting logico-deductive readings cannot arise in this interpretation. (shrink)

Confirming Robinson’s Statement? A Lakatosian Analysis of Keynes and his Immediate Orthodoxy Jesús Muñoz Abstract Was the Keynesian message alive during the second half of the XXth Century, or was it betrayed by his followers? This article in the fields of the history of economic thought and methodology contrasts the Scientific Research Programmes (SRPs), a Lakatosian concept, of Keynes in The General Theory of Employment, Interest and Money (TGT) with those of its immediate orthodox schools: Monetarism (MS), Neoclassical Synthesis (NS), (...) New Classical Macroeconomics – rational expectations – (RE) and General Disequilibrium (GD). The objective is to to assess the immediate impact of Keynes’s vision in economics. It can be concluded according to this comparison that Keynes’s bequeath was alive during the period between 1950 and 1980, but that it was accepted under different names. Many economists deny this statement. However it is hereby argued with the help of Lakatosian methodology that in both economic and philosophical terms the MS, NS, RE and GD SRPs are degenerative variants of Keynes's SRP. The Keynesian reasoning chain -a non self-regulated system, non neutrality on the part of money, organicism, non-ergodicity, historical time and uncertainty- is misunderstood and hence misapplied on the part of these deviant schools, or transformed into “bastard Keynesianism”, to quote Joan Robinson (Joan Robinson, 1975[1973], 125). In other words, Keynes’s economics is different from Keynesian economics as was firstly proposed by Axel Leijonhuvfud (Leijonhuvfud, 1968). The internal history of macroeconomics in those periods is undertaken, since it is is the rational reconstruction of the meaning of a SRP. Section 1 is an introduction to basic concepts related to philosophy of science and methodology, especially Lakatosian methodology, which can be skipped by the specialized reader. Section 2 is an analysis of Keynes’s hard core in his SRP, also being an introduction to the problem as it outlines Keynes’s thinking, Section 3 describes initial Post Keynesianism, which was faithful to the original message. Sections 4, 5, 6 and 7 outline the hard cores of Monetarists, Neoclassical Synthesis, New Classical Macroeconomics and General Disequilibrium, respectively. El enfoque central de esta investigación es la configuración teórica de la violencia en La ciudad y los perros y la interacción representada entre los personajes principales (para aludir al Jaguar, el Poeta y el Esclavo; para ellos ha usado convencionalmente el término «tríada protagónica»; a la vez, asume que estos personajes podrían ser entidades dispuestas a los posteriores análisis). Desarrolla la metateoría de los triángulos jerárquicos — la cual será convencionalmente graficada de forma piramidal, para que con ello se (...) represente la idea de superioridad e inferioridad con respecto a algún rango asignado a los valores o los personajes —, estos facilitarán la demostración del carácter evolutivo de la violencia en la tríada protagónica (por lo que el Esclavo sería un primer portador mínimo de la violencia; luego, el Poeta, con un poco más de agresión; y, finalmente, el Jaguar, quien estaría configurado como violento, dandi, agresor y manipulador). Esta investigación retoma la obra de Gabriel García Márquez, Noticia de un secuestro (1996), con la volición de cuestionar la idea de Estado nación que está inmersa en el libro. Para ello, es necesario entender que la naturaleza del texto exige un conocimiento amplio al lector o al intérprete, puesto que su contenido revela datos multidisciplinarios. Además, es insoslayable realizar un análisis discursivo de la historia de ese contexto y cotejar con pasajes del mismo libro. Para facilitar esta labor, la (...) extrapolación de conceptos del teórico Luis Rodríguez Manzanera será de utilidad, ya que él despliega definiciones de Criminología, un tema frecuente en la obra. Verbigracia, la macrocriminalidad, una noción que él postula, permite que se comprenda la complexión del periodo histórico finisecular del siglo XX en Colombia, etapa que le corresponde a Noticia de un secuestro. Por otro lado, es menester dilucidar que este estudio no se reduce a lo literario, lo histórico y lo criminológico, sino que abarca distintas disciplinas, por lo que la exigencia en la consolidación epistemológica e interpretativa estará demostrada consuetudinariamente, sin obviar la inmanencia de la obra. Este tipo de análisis interdisciplinarios ya ha sido trabajado desde los Estudios Culturales, tal como se constata en las investigaciones de Richard Johnson (2000) o Néstor García Canclini (1997). De igual modo, el intento de establecer lineamientos y conexiones entre disciplinas como las de Literatura y Derecho ya ha sido desarrollado por Stanley Fish (1986), Faustino Martínez (2005), Carlos Pérez (2006) y Denise Schalet (2014). A diferencia de estos abordajes ya estudiados, el objetivo de esta investigación es detectar y fundamentar cómo se articula una propuesta ideológica desde una configuración que reanuda elementos históricos y literarios. En específico, lo que se busca es argumentar por qué fracasó implícitamente un proyecto sociopolítico de democracia y progreso, a partir de un panorama de violencia, narcoterrorismo, corrupción, negociaciones ilícitas, transgresión a los derechos humanos e inseguridad ciudadana. Con todo ello, esta tesis de maestría terminará siendo fructuosa para análisis postremos de discursos que tienen como esencia un soporte multidisciplinario. (shrink)

For the theoretical construction that will allow the analysis to News of a Kidnapping (1996), I rely on the establishment of the sociological character of the disciplines of Literature and Criminology (the way of organizing society, through certain laws and regulations), besides having other similarities (artistic, interpretative and written dimensions), as pointed out by Perez (2006). The way of articulating these proposals is somewhat problematic, because there is no interdisciplinary link that is fully and intellectually elaborated, according to Nelson, Treichler (...) and Grossberg: difficulty that would not allow contextualizing, theorizing and questioning the bases with which we work. For this reason, Cultural Studies would have a necessary functionality: its methodology does not have guarantees on the privilege that is granted to the internal structures of the interdisciplinary. For this, I have developed two guidelines by which that phenomenon could be explained: the literary and criminological approaches. (shrink)

A theory of knowledge is the explanation of things in terms of the possibilities and capabilities of the human way of knowing. The human knowledge is the representation of the things apprehended sensitively either through the senses or intuition. A theory of knowledge concludes about the reality of the things studied. As such it is a priori speculation, based on synthetic a priori statements. Its conclusions constitute interpretation, that is, hermeneutics. Linguistics as the science studying real language, that is, the (...) language spoken, reverts to human subjects in as much as they speak, say and know. It is difficult to advance a point beyond what Keynes himself commented about his own vision in The General Theory of Employment, Interest and Money in 1936 (hereafter TGT) in its Chapter 24. It is also difficult to express a deeper thought than what Skidelsky wrote about Chapter 24 of TGT (cf. Skidelsky, 1997). The purpose of this article is to identify whether Chapter 24 of TGT is the gist of Keynes’s legacy, having set the foundations of macroeconomics in the (...) previous 23 Chapters. Relevant topics included in Chapter 24 are the consequences of full employment, the fate of income distribution, the future of overall wealth, the socialization of investment, saving, expectations, the role of the State in economies, the future of financial markets and the interaction between economics and other disciplines. Indeed this Chapter displays Keynes’s genius as a social philosopher, following the tradition of The Economics Possibilities for our Grandchildren (1930). In Chapter 24 he was taking a glance at his product as did Phillip II when he was observing the construction of his castle El Escorial in XVII Spain. Within his vision, is this piece of work a justification of capitalism? Keynes sees the State as both the spender and the employer of last resort, thereby proposing a new role for the government (Skidelsky, 1998). He also suggests a new role for the private sector and reconsiders the interrelation between the two sectors. He is fully optimistic about this issue, which he considers as evolutionary. In addition, Keynes blurs the distinction between economics and sociology, advancing new interdisciplinary hints in his thinking. Keynes is also concerned on the epistemological role of assumptions in order to obtain defensible conclusions. Thereafter the British economist proposes new methods. He was a neo-realist and was against the inductive method. In addition, it can be stated that TGT is grounded on new psychological laws and motivations, that is, on a new vision of humankind, especially the analyzed chapter. His topics are the bypassing of Classical Economics; the destiny of macroeconomics in both theoretical and policy terms, highlighting new roles for interest rates; savers and rentiers; and the relevance of the concepts of ideas, interests and power. In all these respects Keynes is once again far ahead of his time. Finally a debatable topic dealt with by Keynes in Chapter 24 of TGT is 1 PhD in Economics, Lancaster University, UK; Professor-researcher at ISEC Universidad de Negocios, Mexico City. socialisation of investment. This is in words of Skidelsky, a shift in the balance of social power. Keynes is thus in Chapter 24 of TGT a visionary and an idealist, a reformer, and certainly a trans-generational thinker. When he talks about the passion of thriftiness and the setting of reasonable financial rewards arising from financial instruments he is advancing explications for financial crises in terms of speculation. The open conclusion is that Chapter 24 contains the gist of Keynes’s mature philosophical thinking and legacy, confirming that for him attitudes are one of the most relevant issues in life. In addition, he considers that both social and psychological elements are necessary for a thorough understanding of economic issues and their consequences, such as peace and happiness. Section 1 is an introduction. Section 2 is both a literature review and a summary of Keynes’s general philosophical insights. Section 3 is an analysis of Chapter 24 of TGT in the specific fields of Epistemology, Ethics, Ontology, and Political and Social Philosophy. Section 4 is a conclusion. Will be the characteristics of the next universes random or tend to something? Reductive intellectualists (e.g., Stanley & Williamson 2001; Stanley 2011a; 2011b; Brogaard 2008; 2009; 2011) hold that knowledge-how is a kind of knowledge-that. If this thesis is correct, then we should expect the defeasibility conditions for knowledge-how and knowledge-that to be uniform—viz., that the mechanisms of epistemic defeat which undermine propositional knowledge will be equally capable of imperilling knowledge-how. The goal of this paper is twofold: first, against intellectualism, we will show that knowledge-how is in fact resilient to being undermined by (...) the very kinds of traditional (propositional) epistemic defeaters which clearly defeat the items of propositional knowledge which intellectualists identify with knowledge-how. Second, we aim to fill an important lacuna in the contemporary debate, which is to develop an alternative way in which epistemic defeat for knowledge-how could be modelled within an anti-intellectualist framework. Abstract: Our soul, as Plato proposed, responds to the nature, functions and interaction of the three parts of which it is composed, without this preventing it from possessing a unitary character. His model of psychism respected the universal perception of the diversity of soul entities, but, by using the tools provided by Greek thought, he turned them into components of a process of opposition and dialectical ascent that reproduced within man the structure of the cosmos. The triangular systems of Aristotle, (...) Kant and Freud are indebted to the power of the Platonic scheme and, at the same time, they have contributed to making the strategy of the tripartite soul one of the fundamental references in philosophy. Key words: tripartite soul, dialectical ascent, unitary character, cosmos, triangular systems. --------------- Resumen: Nuestra alma, propuso Platón, responde a la naturaleza, funciones e interacción de las tres partes de las que se compone, sin que ello impida que, a la vez, posea un carácter unitario. Su modelo de psiquismo respetaba la percepción universal de la diversidad de las entidades anímicas, pero, valiéndose de las herramientas proporcionadas por el pensamiento griego, las convertía en componentes de un proceso de oposición y ascenso dialéctico que reproducía en el interior del hombre la estructura del cosmos. Los sistemas triangulares de Aristóteles, Kant y Freud son deudores de la potencia del esquema platónico y, a la vez, han contribuido a que la estrategia del alma tripartita sea uno de los referentes fundamentales de la filosofía. Abstract Democracy is a fundamental right linked to the realization of a person’s worthy life project regarding its corresponding fulfillment of Human Rights. Along with the procedures to form political majorities, it is mandatory to incorporate the substantial part as a means and end for the normative content of Human Dignity to be carried out allowing it to: i) freely choose a project of valued life with purpose and autonomy ii) to have material and intangible means to function in society; (...) and iii) to live free from harm and fear in order to achieve human flourishing. The integral democracy is a means and an end to materialize individual happiness and the common good as long as everyone has concrete opportunities to unfold its inherent human dignity capacities within the trademark of the democratic constitutional State. Assuming this, integral democracy is the fundamental right of Fundamental Rights. (shrink)

Se estudia, con fines académicos, el proceso penal de única instancia o de jurisdicción privilegiada, ante la Suprema Corte de Justicia (SCJ) de República Dominicana, previsto en el artículo 154.1 de la Constitución dominicana de forma expresa con el objetivo de asegurar el funcionamiento de altos cargos del Estado siendo sujetos procesales pasivos aquellos funcionarios públicos investidos de inmunidad o fuero procesal. Para que la SCJ tenga competencia judicial inobjetable y pueda juzgar válidamente, en única instancia, a personas particulares sin (...) dicha prerrogativa procesal, por arrastre o por conexidad de la causa, tiene que estar autorizada expresamente por la ley procesal penal dominicana (que no es el caso) sin que le valga invocar la jurisprudencia interna porque contradice el derecho convencional y desconoce decisiones vinculantes -cosa interpretada de la Corte Interamericana de DDHH. Este artículo analiza el ordenamiento electoral de República Dominicana, en sintonía con una tendencia común del derecho público de Occidente, que tipifica el transfuguismo político-electoral y sanciona la conducta desleal del tránsfuga contra las decisiones o los postulados del partido político, con la limitación de sus derechos políticos pasivos, no pudiendo ser postulado ni ser elegido a cargos de elección popular. El transfuguismo traduce una restricción de tipo legal interno contra todo actor político que traiciona a sus compañeros de partido, (...) a su partido o las decisiones de sus órganos partidarios, pactando con otras fuerzas políticas, basada en normas constitucionales, convencionales y en decisiones de organismos judiciales o instancias internacionales de protección de derechos humanos que, de manera vinculante, por efectos de la cosa interpretada (res interpretata), le confieren legitimidad y validez jurídica a la inhabilitación que se impone al transgresor frente a su conducta de perfidia político-partidista. Esto incluye la restricción del goce de sus derechos políticos pasivos, prohibiéndole ser nominado como candidato a cargos públicos, limitándole el derecho a ser elegido, como consecuencia de prácticas de transfuguismo político-electoral.
